Terms of Use

1. Acceptance

These Terms of Use ("Terms") govern your access to and use of the Reclaim mobile application ("App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

These Terms incorporate our Privacy Policy by reference.

2. Eligibility

You must be at least 18 years old to use Reclaim. By using the App, you represent and warrant that you are at least 18 years of age. While the Apple App Store classifies Reclaim with a 17+ age rating based on its content categories, the App's own eligibility requirement is 18 years of age due to its subject matter related to sexual wellness and addiction recovery.

3. Description of Service

Reclaim is a personal wellness and recovery tool for iPhone. It provides guided panic support sessions, daily journaling, kegel training, mindfulness practice, and progress tracking through four rolling wellness scores. All features operate locally on your iPhone.

4. No Medical or Emergency Service

Reclaim is not a medical provider, therapist, crisis service, or emergency response system. The App does not provide medical advice, diagnosis, or treatment.

If you are in danger, in crisis, or experiencing a medical emergency, do not rely on the App. Contact local emergency services or a qualified professional immediately. In the United States, you can reach the 988 Suicide and Crisis Lifeline by calling or texting 988.

5. User Responsibility

You are responsible for:

• Deciding how to use the App
• Entering accurate information if you choose to use tracking features
• Protecting access to your device and your local data
• Maintaining device-level backups if you wish to preserve your data

6. License Grant

Subject to your compliance with these Terms, Reclaim grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a single Apple device that you own or control, for your personal, non-commercial use. This license does not allow you to distribute, sublicense, or make the App available over a network.

7. Acceptable Use

You agree not to:

• Misuse the App or use it for any unlawful purpose
• Reverse engineer, decompile, or disassemble the App beyond what applicable law permits
• Use automated systems or software to extract data from the App
• Use the App in a way that harms other users, Apple platform services, or the App itself

8. Intellectual Property

All intellectual property rights in the App — including software, guided audio content, visual design, text, and trademarks — are owned by Reclaim or its licensors. The guided audio content is licensed for personal use only and may not be redistributed, uploaded, shared, or used commercially.

9. Purchases and Paid Features

Reclaim is currently offered as a free application. If paid features, subscriptions, or in-app purchases are introduced, they will be processed through Apple's In-App Purchase system and governed by Apple's terms.

10. Data and Availability

All App data is stored locally on your device. Reclaim does not provide cloud backup or remote data recovery. Data loss from device failure, App deletion, or iOS updates is not recoverable by Reclaim. You are responsible for device-level backups through iCloud or Finder.

11. Changes to the App

Reclaim may be updated, improved, modified, or discontinued over time. We are not obligated to maintain, support, or update the App indefinitely.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RECLAIM, ITS DEVELOPERS, OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL. THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. SOME JURISDICTIONS DO NOT ALLOW THESE EXCLUSIONS, SO SOME LIMITATIONS MAY NOT APPLY TO YOU.

13. Indemnification

You agree to indemnify, defend, and hold harmless Reclaim and its developers from claims, liabilities, damages, and expenses arising from your use of the App, your violation of these Terms, or your violation of any rights of another party.

14. Termination

You may stop using the App at any time by uninstalling it. Sections that by their nature should survive termination — including Limitation of Liability, Indemnification, and Intellectual Property — shall survive.

15. Apple Third-Party Beneficiary

You acknowledge and agree that Apple, Inc. ("Apple") is a third-party beneficiary of these Terms. Upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary.

16. Apple Standard EULA

To the extent not covered by these Terms, your use of the App is also governed by Apple's Standard Licensed Application End User License Agreement. In the event of a conflict, Apple's Standard EULA prevails with respect to Apple's rights.

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.

18. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected in the effective date above. Continued use after changes constitutes acceptance.
